Understanding The Criminal Justice Process In Florida

Whether the police have already arrested you or you fear they have you under investigation, it is not too soon to contact me. The sooner you reach out to an attorney, the better I can protect you throughout the process. You have the right to consult with an attorney at any time.

In Florida state courts, once the police arrest you, you will face your first court appearance within 24 to 48 hours. The court will read your charges and set your bail at this time. Your next appearance will be a preliminary hearing where you may ask to exclude evidence, dismiss your charges and begin building your defense. Plea bargaining often starts at this point, assuming the judge does not dismiss the case. The next step is your arraignment, which is the formal charging stage where you enter your plea.

If you plead not guilty, the judge will set your case for a trial date and we will prepare for trial. At trial, you may be found guilty of one or more charges, in which case you will face sentencing, or the jury could acquit you of all charges.

If you face federal charges, the process is similar, but may look a little different. For one thing, federal investigations often take longer and you may know that you are under investigation.
